Privacy Policy

UpMerQ is operated by NSB Creative Solutions, a Wyoming LLC ("UpMerQ," "we," "us," or "our"). This Privacy Policy explains what information we collect, how we use it, and who we share it with, across upmerq.com (the platform where business owners build their stores) and upmerq.store (the storefronts where customers shop).

This policy applies to two groups of people: business owners who create a store on UpMerQ, and customers who buy from those stores. We call out where practices differ between the two.

1. Information We Collect

From business owners

• Account information: business name, email address, and password (managed securely through Supabase Auth — we never see or store your plaintext password).
• Logo and brand assets: the logo file you upload, and the primary, secondary, and accent colors we automatically extract from it.
• Store configuration: product selections, pricing, store template, hero images, and any customization you save to your dashboard.
• Payment and payout information: when you connect Stripe, Stripe collects and verifies your identity, bank details, and tax information directly. We receive only your connected account ID and onboarding status — we do not see your bank account or tax ID numbers.
• Referral information: if you refer another business or are referred, we store the relevant account IDs and referral status.
• Beta and promotional program information: if you join a beta or promotional program, such as the Founding Partner program, we store your program cohort, invite status, and related reward status.

From customers

• Order information: name, email address, shipping address, and order contents, collected during checkout.
• Payment information: collected and processed directly by Stripe. We never receive or store full card numbers.

We do not require customers to create an account. All storefront purchases are guest checkout.

Collected automatically

• Standard technical data such as browser type, device information, and usage patterns on our sites, used for security and to understand how the platform is used.

2. How We Use Information

We use the information above to:

• Create and operate your store, including generating products with your logo via our fulfillment partner
• Process payments and send weekly payouts to business owners
• Fulfill customer orders, including sharing the minimum information necessary (name and shipping address) with our fulfillment partner
• Screen uploaded logos for potential trademark conflicts, as a courtesy check before your store goes live
• Remove backgrounds from uploaded logo images
• Send transactional emails you or your customers would expect, such as order confirmations, shipping notifications, and account milestones
• Send occasional re-engagement or account-status emails to business owners (you can opt out of non-essential emails at any time)
• Administer referral, beta, and other promotional fee programs, including tracking eligibility and reward status
• Maintain platform security, prevent fraud, and comply with legal obligations
• Calculate platform statistics and fees owed
• Respond to customer support requests, including refund and order issues, which UpMerQ handles directly as merchant of record

We do not sell personal information, and we do not use your data for third-party advertising.

3. Who We Share Information With

We share information only as needed to operate the service:

Each of these providers is contractually or technically limited to using data for the purpose we send it for. We do not share customer or business data with any other third party, and we do not permit our fulfillment or infrastructure partners to use your data for their own marketing.

We may also disclose information if required by law, to protect the rights and safety of UpMerQ, our users, or the public, or in connection with a merger, acquisition, or sale of assets (in which case we'll notify affected users).

4. Data Retention

We retain business and order data for as long as an account is active, and for a reasonable period afterward to comply with tax, accounting, and legal obligations. If a store is deleted through the admin panel, associated data is removed via a cascading deletion process, except where we're required to retain financial records by law.

5. Data Security

We use industry-standard safeguards, including row-level security policies in our database that restrict access to a business's own data, encrypted storage for uploaded assets, and role-based access controls for administrative functions. No system is perfectly secure, and we encourage business owners to use strong, unique passwords.

6. Your Choices and Rights

• Access and correction: Business owners can view and update most account and store information directly from the dashboard.
• Deletion: You may request deletion of your business account and associated data by contacting us. Note that some financial records may be retained as required by law.
• Email preferences: Non-essential emails (re-engagement, digests) include an unsubscribe option. Transactional emails necessary to operate your store or fulfill an order cannot be turned off while your store is active.
• Depending on your location, you may have additional rights under applicable privacy law (such as the right to know, delete, or opt out of certain processing). Contact us to make a request.

7. Children's Privacy

UpMerQ is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can remove it.

8. International Users

UpMerQ is operated from the United States, and data is processed and stored in the United States through our infrastructure providers. If you access UpMerQ from outside the U.S., you understand your information will be transferred to and processed in the U.S.

9. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify business owners by email.
